COLUMBUS, OH - The voter approved workplace smoking ban in Ohio is being challenged in the courts, but not to stop enforcement - to stop the exemption status of certain military and private clubs. Not even a week after a trade group representing Ohio bar owners & other liquor permit holders filed a lawsuit citing an unfair competitive advantage, the American Cancer Society decided the timing was right for a lawsuit of their own in the same court. However, the basis of the ACS's lawsuit focuses on the belief that this particular exemption causes confusion among those who are expected to abide by the legislation, and undermines the ban's purpose.
