RENO, NV - Clark County's enforcement of the smoking ban has come to a halt, while a determination is made as to whether it's constitutional or not. Even though it hasn't been granted exemption like Clark County, the County of
Churchill has also decided to hold off on any form of enforcement until the fine print becomes clearer. The law as it is written, gives law enforcement & health officials the responsibility of issuing citations for anyone considered to be in violation of the smoking ban, but it does not specify who is to receive the citation - the smoker or the business allowing the smoker to light up. Either way, a question has also been raised as to the dedication which would be required of police officers patrolling restaurants (normally not a common destination of patrols.) Until these wrinkles can be ironed out in court, the smoking ban will cease. To be sure the law is well understood, Fallon Police Chief Russ Brooks will be recommending a period of time to be dedicated to educating residents before citations are written.
