Judge to rule on smoking ban's constitutionality

A Pitt County District Court judge will decide if the state’s smoking ban is unconstitutional and if four local private clubs should be fined for violating the law.

Judge G. Galen Braddy heard from attorneys representing the club owners and the Pitt County Board of Health during a civil hearing Monday afternoon. Braddy is now reviewing the evidence and a decision is pending. Story continues here
