A Sioux City bar caught in a crackdown against smoking hopes to light a little fire of its own.
Dalton's Pub was set to be shut down for 30 days by the Alcoholic Beverages Division after patrons were caught smoking in the bar, but the owner says they shouldn't be in the wrong because the smoking ban is unconstitutional.
Owner Bob Bennett says 70 percent of his bar customers smoke, and while he agrees smoking is bad, he says as a business owner his rights have been violated by the ban.
He claims exemptions to the ban enjoyed by casinos and on the state fairgrounds violates Iowa's constitution, which says no law should grant special privileges or immunities. It's on this premise that he and his attorney are trying to take his case to court.
